Trash Dash LLC Terms and Conditions

1. Agreement to Terms
These Terms and Conditions (“Agreement”) constitute a legal agreement between you (“you” or “Customer”) and Trash Dash LLC (“Trash Dash,” “we,” “us,” or “our”), a limited liability company organized in New Mexico, operating primarily in Tulsa, Oklahoma. By using the Trash Dash platform (“Platform”) or services, you agree to be bound by this Agreement. This document governs both Customers and Trash Dashers (independent contractors providing services).
2. Definitions
– **Customer**: Any person subscribing to Trash Dash services.
– **Trash Dasher**: Independent contractor authorized by Trash Dash to transport trash bins to and from the curb.
– **Trash Dash Services**: Trash bin transportation services as described on the Trash Dash Platform, exclusively for trash and recyclables.
– **Bin**: Any trash or recycling container at a Customer’s residence.
– **Confidential Information**: Any personal or proprietary information provided by either party under this Agreement, governed by privacy laws.
3. Independent Contractor Status and Payment Terms
Trash Dashers are independent contractors and are not employees of Trash Dash. They are responsible for their own expenses, including gas, vehicle maintenance, and insurance, and they bear full responsibility for taxes on earnings received through Trash Dash.
Trash Dash LLC reserves the right to deduct a $12 fee per missed bin if Trash Dash LLC must step in to handle the service. Trash Dash will notify the Trash Dasher by email if deductions apply.
4. Responsibilities and Service Limitations
Trash Dash Responsibilities
– Provide access to the Platform, enabling Trash Dashers to view and accept available routes.
– Handle subscription billing and payment processing through Stripe, ensuring PCI compliance.
– Provide reasonable assistance for reported service issues.
Customer Responsibilities
Customers agree to:
– Ensure bins are used only for standard trash or recyclable materials, with no hazardous items.
– Provide safe, accessible locations for Trash Dashers to retrieve and return bins, including gate/garage codes if necessary.
– Accept that Trash Dash is not responsible for issues caused by Trash Dashers, including delays or property damage.
5. Liability and Indemnification
Trash Dash LLC disclaims liability for harm or injury Trash Dashers might experience, including risks from pets or environmental hazards. Trash Dashers agree to indemnify Trash Dash LLC from any claims arising from their actions. Customers agree to indemnify Trash Dash LLC for claims resulting from bin misuse or hazardous materials.
6. Customer Compensation and Refund Policy
Trash Dash LLC may issue refunds or provide additional service if service fails due to Trash Dashers. Refunds will be prorated based on the subscription amount and days remaining. Trash Dash is not liable for delays caused by Trash Dashers.
7. Privacy Compliance
Trash Dash adheres to U.S. data privacy standards. Personal information, including data for payment processing, is securely managed and accessible only for business purposes.
8. Non-Compete and Non-Solicitation
Trash Dashers are prohibited from offering similar services to Trash Dash customers without written consent. Violating this clause may result in legal action, including financial damages and litigation.
9. Right to Modify Routes and Terminate Services
Trash Dash LLC reserves the right to modify or terminate routes for Trash Dashers based on missed pickups or misconduct. Access to the Platform can also be revoked at any time.
10. Dispute Resolution
Any disputes will be resolved through binding arbitration under the American Arbitration Association’s rules. Class actions are waived, and disputes must be brought individually.
11. General Terms
This Agreement is governed by New Mexico law. Trash Dash reserves the right to modify these Terms at any time. Continued use of Trash Dash services constitutes acceptance of revised terms.
